1 - General information

The present Terms & Conditions of use are intended to govern the contractual relations between the France Simulateur SARL company SARL, whose head office is located at the following address:

All other conditions engage the France Simulateur SARL company only after written confirmation of its part. The information appearing on this site can be modified by the France Simulateur SARL company without further notice. The only fact of placing an order on the www.rseat-europe.com site involves the acceptance without reserve of the present General Conditions of Sale.

The essential characteristics of the products and services offered for sale are presented on the site in the "Products" section.

 

3 - Period of validity of the offers

The products are offered for sale while stocks last. For products that are not in stock in our warehouse, our offers are dependent on availability from our suppliers. In case of an order of an unavailable product, the customer will be informed through his customer account available on the site and / or by email as soon as possible.

 

4 - Product pricing

The prices shown on the site www.rseat-europe.com are expressed in Euros and are understood, excluding shipping costs. They can be modified at any time and without notice.
To this price, it is important to add the transport costs calculated according to the nature of the ordered articles and the carrier. The shipping costs are specified on the screen at the end of the selection of the different products by the customer, and are recalled in the summary of the order that precedes the validation.
The price is payable in full on the day of the order. The prices charged are those applied at the time of the order within the limits of available stocks and subject to typographical error. Any change in this rate would then be immediately reflected in the selling prices.

Outside the European Union or in the DOM-TOM, and according to the legislation in force in the delivery zone, customs fees and duties and taxes may be claimed by them from the Customer.
Certain products may benefit from a "Free shipping" offer. The port is then offered free shipping only for a shipment to Metropolitan France. If other products are shipped at the same time, the weight of the products benefiting from the "Free shipping" offer will not be taken into account in the calculation of shipping costs.

 

5 - Orders

If the customer wishes to place an order, he will have to identify himself initially. For this purpose, he will fill out, according to the indications provided online, a form available to him where he will include the information necessary for his identification and in particular his name, first name, telephone number, postal and e-mail address and billing and delivery address. Additional information may be requested subsequently to ensure the quality and safety of the delivery. All information is presented to the customer in English and French.

The customer having chosen the products presented, will definitively validate his order by clicking on the button "Validate the order" to show his commitment and his acceptance of the General Conditions of Sale. From this moment, the order is recorded, and an order number is communicated to the customer as well as a confirmation on the screen and/or by e-mail. The data recorded by the France Simulateur SARL company constitute the proof of the nature, the contents and the date of the order.

 

6 - Late payment

If the customer is a professional: in application of article L. 441-6 of the French Commercial Code, late payment penalties are due the day following the payment date shown on the invoice in cases where the sums due are paid after this date. The rate of these penalties is equal to the Refi rate increased by 7 points. The acceptance of your package automatically entails, in case of late payment, the application of a late payment penalty of 10.00 Euros per week of delay, depending on the amount of the unpaid invoice.

 

7 - Delivery methods


The delivery of the packages will be made by a specialized carrier; KUEHNE+NAGEL, GEODIS, DHL and ZIEGLER. We deliver to Metropolitan France and most of the countries on the European continent. For the DOM-TOM thank you to send us a request via the contact form so we can calculate the amount of the shipping costs. It is necessary to be present during the delivery of your package to allow delivery in the best possible conditions. The transport does not include delivery to the floors which remains at the approval of the driver.

Upon receipt of the goods, the customer must immediately check their condition and conformity. All claims relating to a defect in the goods delivered, an inaccuracy in the quantities or an erroneous reference to the order confirmed by the France Simulateur SARL company , must be made in writing on the transport slip. If the goods are damaged, it is imperative to refuse the product and to stipulate the cause in writing on the transport note.

In addition, the France Simulateur SARL company reserves the right to refuse any order from a customer with whom there is an ongoing dispute.

 

8 - Delivery times

If the item ordered is available in stock, the order preparation time is 24 to 72 hours after validation of payment and the average shipping time is about 2 to 7 working days for France and 3 to 10 days for Belgium, Switzerland and Luxembourg. For any order placed before 9:00 am and upon validation of the receipt of payment, the shipment will take place 24 to 72 hours after. In the event of out-of-stock condition, the replenishment period is approximately 3 weeks. Shipping times will only start from the date of payment of the order.

In case of force majeure or exceptional events (natural disaster, epidemic, strikes, lock-out, etc.) delaying or prohibiting the delivery of goods, the France Simulateur SARL company is released from any responsibility. In all cases, the delivery within the deadlines can intervene only if the customer is up to date with his obligations towards the France Simulateur SARL company .
Any cancellation of order, whatever the reason, and accepted by the France Simulateur SARL company will give right to the only refunding of the paid sums. No compensation relating to this cancellation can be requested. The customer will have to check at the time of the delivery the good state of the parcels and their contents, in the event of damage or of missing product, will specify his reserves detailed on the delivery order and will confirm them, in the three days of the delivery, by telephone, mail or email with the France Simulateur SARL company and by mail recommended AR addressed to the conveyor himself.

 

9 - Claim

By signing the delivery note, the customer accepts the products delivered in the state and therefore no claim for damages during transport will be accepted. It is the responsibility of the customer to make all checks and detailed reservations upon arrival of the equipment. Upon receipt of the goods, the customer must immediately check their condition and conformity. All claims relating to a defect in the goods delivered, an inaccuracy in the quantities or an erroneous reference to the order confirmed by the France Simulateur SARL company , must be made in writing within 10 (ten) days of receipt of the goods. France Simulateur can in no case be held to compensate or cancel an order following the impossibility to use the purchased product for a reason of incompatibility with the equipment or with the installation site of this one.


10 - Invoicing

A detailed invoice may be sent to the customer electronically. The indication of the amount of the V.A.T. gives the possibility to communities, companies and liberal professions to recover it.

 

11 - Payment methods

The France Simulateur SARL company reserves the right to ask for a bank check, a transfer, a proof of identity and/or a proof of residence to the Customer within the framework of the validation and the treatment of his order, to ensure the quality and the safety of the delivery of his parcel.

12 - Warranty and after-sales service

All products sold on www.rseat-europe.com are guaranteed 2 (two) years, return-workshop warranty at the Aspach-Michelbach warehouse, for return by carrier (from the date on the invoice), except for batteries and rechargeable batteries.
If the guarantee is taken over by the France Simulateur SARL company , after the first years, transport and intervention costs may be invoiced to the end customer, having previously informed him of the precise and detailed amount of this intervention.
According to the products and the date of purchase, the repair will be done either by the France Simulateur SARL company or by the manufacturer directly.

This warranty does not cover damage resulting from accidents, misuse, negligence or significant changes in the appearance or operation of the returned equipment. Any equipment showing traces of shock or overheating, even slight, will lose all rights to the warranty.
Any return of goods, outside the retraction period, requires the prior agreement of the France Simulateur SARL company and the obtaining of a return number issued by it to the customer, which must be very legibly written on any returned package. The return of goods is at the expense, risk and peril of the customer. Products returned by carrier without physical protection or poorly protected will not benefit from the guarantee, it is therefore up to the customer to protect and insure the returned product(s) during transport. It is up to the customer to keep the packaging, accessories supplied with the product as well as any labels affixed to the product or its packaging, and which are necessary to benefit from the guarantee offered.

In accordance with Order 2005-136 of February 17, 2005 and Article R211-4 of the Consumer Code, the provisions hereof may not deprive the consumer of the legal guarantee which obliges the professional seller to guarantee him against all consequences of hidden defects of the thing sold or the service rendered. This clause is applicable only in the event of complete payment of the order. The France Simulateur SARL company is not the producer of all the products presented, within the meaning of the law n°98-389 of May 19, 1998 relating to the responsibility because of the defective products. The France Simulateur SARL company will take care to apply the guarantee on any returned product as soon as possible. However, when the repair requires the return of the product to the producer, it can not be held responsible for any delays caused by the producer. On the other hand, the after-sales service of the France Simulateur SARL company will choose the carrier responsible for delivering the goods to the customer.

 

13 - Right of withdrawal / Returns

In accordance with the legal provisions, the cancellation period only applies in favour of a consumer customer. The consumer has a period of 14 (fourteen) clear days from the delivery of the product to his home to exercise his right of withdrawal or the taking possession of the last lot or when the order consists of several lots or goods.

To initiate the return process, please go to the “Returns” page at the bottom of this page (you will need to log in to your RSeat Europe account if you haven’t already). Fill the product Returns with the product(s) you wish to return. Before the request is submitted, you will be prompted to provide additional information about the reason for your return request. Please be sure to contact us prior to returning something in order to make the process as seamless as possible, then wait for our feedback to allow to proceed with the return.

 

If you change your mind, you can return your items within 14 days and receive a full refund for the product, excluding outward carriage costs.
However, you are responsible for all return postage costs for non-defective items, as well as restocking charges of up to 50%.

The returned product must be in perfect condition, with no trace of wear or assembly, in its original packaging, with all its accessories and instructions for use so that the product can be marketed again, and must be accompanied by the purchase invoice.
Any product that is incomplete, damaged, soiled, with traces of wear or perspiration on the steering wheels, scratches from assembly or fitting, traces of tightening, damaged threads, damaged packaging or whose original packaging has been damaged will not be reimbursed or exchanged.


 

For returns of non-defective large item(s) the same rules apply, however, you are responsible for paying return freight. Freight fees on large item range between 40€ and 400€. Restocking fees of up to 50% will be deducted from any refund/credit on items that are not damaged or defective. Remember to contact us before you return your items.

 

Due to the expense of shipping heavy items, large items are subject to additional terms. Be sure to carefully inspect all Heavy Item (freight) deliveries for damage before signing the bill of lading as freight handling charges cannot be refunded. If item(s) arrive damaged or defective, you must note this on the shipping receipt and refuse delivery to avoid paying return freight charges. Otherwise you will be responsible for return freight charges back to us or the manufacturer. Please notify us of any delivery problems as soon as possible. In situations where a damaged product can be repaired by either a factory-technician or end-user, >the France Simulateur SARL company may opt to provide replacement parts and/or a service technician instead of returning the whole item. Please note that you will be responsible for the additional freight costs in the following instances:

  1. You miss your delivery appointment
  2. You refuse or return a non-damaged, non-defective item

14 - Property rights and liability

The France Simulateur SARL company retains ownership of the goods until full payment by the customer. The transfer of property of the products to the customer is carried out at the time of the integral payment of the price.

The non-fulfillment by the customer of its obligations of payment, for whatever reason, confers on the France Simulateur SARL company the right to require the immediate restitution of the goods delivered at the expenses, risks and dangers of the customer. The customer undertakes, in the case of a receivership procedure affecting its Company, to actively participate in the establishment of an inventory of the goods in its stocks and of which the France Simulateur SARL company claims ownership. Failing this, the France Simulateur SARL company has the right to have the inventory recorded by a bailiff at the expense of the customer. The customer refrains from reselling, transforming or incorporating the goods delivered from the date of the judgment pronouncing the legal redress or liquidation of the goods of his Company. The France Simulateur SARL company may prohibit the customer from reselling, transforming or incorporating the goods in case of late payment. To guarantee the payments not yet carried out and in particular the balance of the account of the customer in the entries of the France Simulateur SARL company , it is expressly stipulated that the rights relating to the delivered but unpaid goods will refer to the identical goods coming from the France Simulateur SARL company in stock at the customer, without it being necessary to charge the payments on a given sale or delivery. In the event of a claim, any advance payments already made shall remain the property of the seller by way of compensation.

 

15 - Data Privacy

The personal data provided by the customer is not disclosed to third parties.
In accordance with the law 78-17 of January 6, 1978, the customer has at any time a right of access and rectification. To exercise this right, simply contact the France Simulateur SARL company. To satisfy the fiscal and legal obligations, a paper and computerized copy of each invoice will be kept by the France Simulateur SARL company .
